TERMS AND CONDITIONS
FOR USE OF HAPPY EXPRESS SHIPPING SERVICES

The Shipping Terms and Conditions of Happy Express, as stated herein ("Terms & Conditions"), constitute the binding agreement for all users of Happy Express shipping services. In these Terms & Conditions, "Happy Express" refers to the shipping service provider, and applies to Senders, Recipients, Partners, and any related parties who use or interact with Happy Express services.

By submitting a Package to Happy Express, the Sender is deemed to have read, understood, accepted, and agreed to comply fully with all provisions set forth in these Terms and Conditions. Happy Express reserves the right to amend or update these Terms and Conditions at any time without prior notice. If the Sender does not agree with these Terms and Conditions, Happy Express kindly requests that the Sender refrain from using the service.

ARTICLE 1
ACCEPTANCE AND LIABILITY FOR PACKAGES
  1. Happy Express is liable for Packages for which shipping fees have been paid in full, unless otherwise agreed between Happy Express and the Sender.
  2. A Package is deemed received in good condition if no complaint is raised at the time of delivery to the Recipient or their authorized representative, as evidenced by the electronic Proof of Delivery (e-POD) signature.
ARTICLE 2
SENDER’S OBLIGATIONS
  1. The Sender must provide complete and accurate shipping information, including full name, phone number, and complete address (street name, house number, RT/RW, village, sub-district, city, and postal code) for both Sender and Recipient.
  2. The Sender must accurately declare the Package contents on the Waybill.
  3. In the event of incorrect information or discrepancies between the declared and actual contents, all legal consequences shall be borne solely by the Sender, and the Sender hereby releases Happy Express from any legal liability under the laws of the Republic of Indonesia.
ARTICLE 3
PACKAGING OF PARCELS
  1. Packaging, including internal placement and cushioning of items, is the Sender’s responsibility.
  2. Upon request, Happy Express may provide professional packaging services according to shipping standards at an additional cost.
  3. Damage or loss resulting from inadequate packaging by the Sender shall be the Sender’s sole responsibility.
ARTICLE 4
LIMITATION OF HAPPY EXPRESS LIABILITY

Happy Express shall not be liable for the following:

  1. Loss of utility of a Package that shows no physical damage.
  2. Delays, loss, or damage caused by force majeure events, including but not limited to natural disasters, riots, rebellion, or circumstances beyond Happy Express’s control.
  3. Technical damage or malfunction of machinery or electronic items during transit that renders them inoperable.
  4. Loss of profit, business opportunity, or indirect losses resulting from delay, loss, or damage to the Package.
  5. Seizure, confiscation, or destruction of Packages by authorized authorities, including but not limited to Customs, Quarantine, Police, Prosecutors, or other government agencies.
  6. Packages classified as Prohibited Items or High-Value Items as defined in Article 5.
ARTICLE 5
PROHIBITED AND HIGH-VALUE ITEMS

Paragraph (1) – Prohibited Items

The following items are strictly prohibited from being shipped via Happy Express:

  1. Living creatures (animals and plants), cash, negotiable instruments (checks, drafts, bonds, shares, certificates, ID cards, family cards, vehicle ownership certificates, driver’s licenses, birth certificates, etc.).
  2. Explosives, weapons and parts, gambling equipment, lottery tickets, narcotics, illegal drugs, perishable food, or easily spoiled items.
  3. Items that violate laws, public morality, or threaten public order and security.
  4. Government-controlled goods, and items made of glass, acrylic, or marble.
  5. Hazardous, toxic, or flammable/combustible chemicals, unless properly packaged with a Material Safety Data Sheet (MSDS) and a signed declaration from the Sender; including alcohol and alcoholic beverages.

Paragraph (2) – High-Value Items

The following items are classified as High-Value Items:

  1. Artwork (paintings, drawings, vases, wall tapestries, etc.).
  2. Antiques (furniture, tableware, porcelain, collectible coins, stamps, etc.).
  3. Jewelry (watches, genuine or imitation gemstones, precious/semi-precious stones, precious metals).
  4. Precious metals (gold, silver, platinum), except when integrated as inseparable components of electronic devices.
  5. Electronic products weighing up to 50 kg (laptops, digital cameras, etc.).
  6. Stamps, excise stamps for alcohol, tax stamps, and vouchers.
  7. High-value commodities (edible bird’s nests, animal fur, silk).
ARTICLE 6
INSURANCE AND COMPENSATION
  1. The Sender is fully responsible for insuring the Package and bearing the insurance premium.
  2. In the event of loss or damage, Happy Express’s compensation shall be based on:
    1. The declared value of the Package (supported by original invoice and payment proof), or
    2. Ten (10) times the shipping fee,
    whichever is lower, subject to the following limits:
    1. Maximum IDR 1,000,000 (one million Rupiah) per incident per Waybill for non-document Packages.
    2. Maximum IDR 100,000 (one hundred thousand Rupiah) per incident per Waybill for document Packages.
  3. Compensation claims must be submitted no later than:
    1. Within 24 hours after the Package’s estimated delivery date — for total loss.
    2. On the same day of Package receipt — for partial loss or damage.
ARTICLE 7
OWNERSHIP OF COMPENSATED PACKAGES

Any Package for which compensation has been paid by Happy Express shall become the property of Happy Express.

ARTICLE 8
GENERAL PROVISIONS
  1. These Terms and Conditions are issued in both Indonesian and English. In the event of any discrepancy, the Indonesian version shall prevail.
  2. Happy Express reserves the right to amend or update these Terms and Conditions at any time.
  3. Continued use of Happy Express services (including website, mobile application, or other platforms) constitutes acceptance of all such amendments.
